Purchases from the Website: Orders and Accuracy of Billing and Account Information

Purchase of products and services through the Website are governed by these Terms of Service, and any of our other policies or terms identified in these Terms of Service or presented to you.

Payment is due prior to shipment of products or receiving any services. When you check out you will be required to provide your payment and shipping information. A receipt will be emailed to the email address provided by you.

We reserve the right to refuse or cancel any orders whether or not the order has been confirmed and your credit card charged (including orders for products or services that are mistakenly listed at an incorrect price). If your credit card already has been charged for the purchase and your order is cancelled, we will issue a credit to your credit card account.

We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made from our Website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Subscription Policy: Subscriptions, Automatic Renewal and Cancellations

If you purchase a subscription to a product through our Website, every thirty (30) days you will receive a shipment containing a one month’s supply of the product from us.

Your subscription will continue on a month-to-month basis unless and until you choose to cancel. Your payment method on file will be charged on the same day of the month that you initiated your subscription at our then-current price for such product plus applicable taxes for subsequent months. You agree that your account will be subject to this automatic renewal feature unless you cancel your subscription with at least fourteen (14) days prior to your next shipment date.

Your subscription will automatically renew until you cancel. You may cancel your subscription at any time by visiting your account page no later than fourteen (14) calendar days before your next shipment date. if you do not cancel your subscription with at least 14 calendar days before your next shipment date, your payment method on file will be charged and you will receive the next shipment. No further charges or shipments will be made thereafter unless and until you renew your subscription. AGAIN, IF YOU CANCEL AFTER YOUR NEXT SHIPMENT HAS BEEN PREPARED OR SHIPPED YOU WILL BE RESPONSIBLE FOR ALL CHARGES (INCLUDING ANY APPLICABLE TAXES AND OTHER CHARGES) INCURRED PRIOR TO THE CANCELLATION OF YOUR SUBSCRIPTION.

We may use a third party payment vendor (“Authorize.net”) to process your payment of Subscription Fees. You warrant and represent that you are the valid owner or an authorized user, of the credit card or other payment card to such Third Party Payment Vendor, and that all information you provide is accurate.

By purchasing a subscription, you expressly acknowledge and agree that we or our third party payment processor is authorized to automatically charge your payment method on file now, and again at the beginning of any subsequent subscription period, without further notice to you for as long as your subscription continues. You agree that we may either terminate or suspend your subscription for any reason at any time in our sole discretion.

Your right to use the service or a specific product is conditional upon our receipt of payment of the associated fees. If payment cannot be charged to your credit card or if a charge is refunded for any reason, we reserve the right to immediately either suspend or terminate your access and account, thereby terminating all our obligations hereunder. We reserve the right to change any of the fees that we charge, or to institute new or additional fees, at any time upon notice to you.

Suspending or Postponing Delivery of your Subscription

You may suspend or postpone the delivery of your subscription following the instructions on the Website. However, you will not be able to suspend or postpone if we have already started shipping your next package.

Payment and Billing Information

By providing a credit card or other payment method that we accept, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third party payment processor) to charge your payment method for the total amount of your subscription or other purchase (including any applicable taxes and other charges) (collectively, as applicable, an “Order”). If the payment method cannot be verified, is invalid, or is otherwise not acceptable, your Order may be suspended or cancelled. You must resolve any problem we encounter in order to proceed with your Order. In the event you want to change or update payment information associated with your account, you can do so at any time by logging into your account and editing your payment information.

You acknowledge that the amount billed may vary due to promotional offers, changes to your subscription, or changes in applicable taxes or other charges, and you authorize us (or our third party payment processor) to charge your payment method for the corresponding amount.

Pricing and Availability

All prices are shown in U.S. dollars and applicable taxes and other charges, if any, are additional. We reserve the right to adjust prices as we may determine in our sole discretion, at any time and without notice; provided, however, that if we change the amounts or other charges associated with your subscription, we will provide advance notice of such changes. We will not, however, be able to notify you of changes in any applicable taxes. The shipment of products, as applicable, to you after our delivery of such notice will confirm your acceptance of such changes, unless you cancel your subscription(s) in accordance with the cancellation policies set forth herein prior to shipment.

All of our products are subject to availability, and we reserve the right to impose quantity limits on any Order, to reject all or part of an Order, to discontinue offering certain products, and to substitute products (including, but not limited to, specific ingredients or entire items) without prior notice. We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of a product or service.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the Store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

Taxes

We will collect applicable sales tax on Products shipped to all jurisdictions for which we determine we have a duty to collect sales tax. If an item is subject to sales tax, you agree that the amount of taxes shown at checkout may be adjusted. Several factors may cause this, such as variances between processor programs and changes in tax rates.

Shipping and Handling

You agree to pay any shipping and handling charges shown at the time you make a purchase. We reserve the right to increase, decrease, add, or eliminate shipping and handling charges from time to time, but we will provide notice of the charges applicable to you before you make your purchase. Generally, shipping is handled by a third-party courier. Actual delivery dates may vary. You agree that you will not obtain, or direct shipment of, a product for export. All products purchased from us are made pursuant to a shipment contract. This means that title to and the risk of loss of such products passes to you upon our delivery of the Product to the third-party courier.

Deliveries

You are responsible for inspecting all products you receive from us for any damage or other issues upon delivery.

If you are not at home when your delivery arrives, the courier will generally leave the package for you at your door or in your mailbox. Any individual at the delivery address who accepts a delivery from us is presumed to be authorized to receive such delivery.

In the case of inclement weather or other events beyond our control that interfere with our ability to deliver your Order, we will attempt to deliver your Order as soon as reasonably possible. In some cases, delivery may occur prior to the scheduled delivery date. In the event that timely delivery of your Order is not feasible, we will cancel your delivery for the period so affected and issue you a credit or refund of the purchase price for that delivery.

No Resale

You are not permitted to resell or otherwise use the products for commercial purposes.

We are not responsible for the validation of the address provided at checkout and will not provide returns, refunds or replacement orders for address errors provided at checkout.

Disputes and Arbitration

Any dispute you have with us should be submitted to info@biomedhealthcenter.com within thirty days of the event giving rise to the dispute. Except for disputes relating to the infringement of your or our intellectual property (such as trademarks, trade dress, copyright and patents) or where you or we are seeking a preliminary injunction (“Excluded Disputes”), you agree that all disputes between you and us (whether or not such dispute involves a third party) with regard to these Terms of Service, your use of the Website or your purchase of any of our products, will be resolved by binding, individual arbitration under the American Arbitration Association’s rules for arbitration of consumer-related disputes and you hereby expressly waive trial by jury. You agree that any action at law or in equity relating to the arbitration provision of these Terms or the Excluded Disputes will be filed only in the state or federal courts located in San Diego County, California and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

In any action to enforce these terms, the prevailing party will be entitled to attorneys’ fees and costs. Any cause of action brought by you against BioMed Health or its affiliates must be instituted within one year after the cause of action arises or be deemed forever waived and barred.

If any provision of these Terms of Service if held to be unlawful, void, or for any reason unenforceable by a court of competent jurisdiction or during an arbitration per the arbitration terms above, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions. We reserve the right to change this dispute resolution provision, but any such changes will not apply to disputes arising before the effective date of the amendment. International Users

The Website is controlled, operated and administered by BioMed Health from our offices in San Diego, California in the United States. BioMed Health does not represent that the materials on this Website are appropriate or available for use in other locations. If you access the Website from a location outside the United States, you are responsible for compliance with all local laws. Returns and Refunds

Our return policy is valid for 30 days from your date of purchase. If 30 days have gone by since your date of purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a full refund, your item must be unused and in the same condition that you received it, unopened, and safety-sealed. It must also be in the original packaging.

To complete your return, we require proof of purchase with first and last name and or your order number. All returns must be accompanied by a BioMed Health Center Return Processing Authorization (RPA) Number.

We are NOT responsible for the cost of return shipping. Shipping costs for the original shipment to you are non-refundable.

If the package is lost, BioMed Health Center is not responsible for it. We recommend you record the tracking number of your shipment.

DO NOT send your purchase back to the manufacturer.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a week.

You will be responsible for paying for your own shipping costs for returning your item, unless the refund was due to defects or error on our part. Shipping costs for the original shipment to you are non-refundable.

Late or Missing Refunds

Any refunds will be credited to the original credit card used at the time of purchase.

Eligible refunds will be processed within 1-2 weeks of our receipt of the product.

Please allow at least 2 billing cycles for the credit adjustment to appear on your credit card statement.

If you haven’t received a refund at that time, first check your credit card account again.

Exchanges

If you wish to exchange a product, you will need to return the unopened product for a refund and place a new order for the product you would like in exchange.

Customers are required to pay shipping costs to ship the original item back to us. Once we receive the original item, you may exchange the product for another one of equal or lesser value. You will be required to pay the difference if the price of the product you request is more than the price of the originally purchased product. You will also be required to pay for shipping and handling of the new item to you.

Damaged or Incorrect Items

If you received the wrong product, we will ship the correct item to you at no additional cost to you.

If an item arrived damaged or defective, we will replace it at no additional cost to you. We may require a photograph of the damaged product.

Shipping Policy

All orders are processed within 1 to 5 business days (excluding weekends and holidays) after you receive your order confirmation email, pending stock. You will receive another notification when your order has shipped.

Due to Covid-19 there may be unforeseen shipping delays with USPS or UPS that are out of our control.

High volume or inability to maintain stock due to high order volume may delay shipping.

How do I check the status of my order?

Subscription Policy

Subscriptions, Automatic Renewal and Cancellations

If you purchase a subscription to a product through our Website, every thirty (30) days you will receive a shipment containing a one month’s supply of the product from us.

Your subscription will continue on a month-to-month basis unless and until you choose to cancel. Your payment method on file will be charged on the same day of the month that you initiated your subscription at our then-current price for such product plus applicable taxes for subsequent months. You agree that your account will be subject to this automatic renewal feature unless you cancel your subscription with at least fourteen (14) days prior to your next shipment date.

Cancellation Policy: Your subscription will automatically renew until you cancel. You may cancel your subscription at any time by visiting your account page no later than fourteen (14) calendar days before your next shipment date. if you do not cancel your subscription with at least 14 calendar days before your next shipment date, your payment method on file will be charged and you will receive the next shipment. No further charges or shipments will be made thereafter unless and until you renew your subscription. AGAIN, IF YOU CANCEL AFTER YOUR NEXT SHIPMENT HAS BEEN PREPARED OR SHIPPED YOU WILL BE RESPONSIBLE FOR ALL CHARGES (INCLUDING ANY APPLICABLE TAXES AND OTHER CHARGES) INCURRED PRIOR TO THE CANCELLATION OF YOUR SUBSCRIPTION.
